This agreement is between myself, Panono Yaga is the "Artist", and you are the "Client".

Failure to comply with this Terms of Service may result in being banned from future commissions.

I, the Artist, am not responsible if the Client fails to read and confirm the Terms of Service. The Client is responsible to clarify any unsure policy with the Artist.

Do not use my artwork for AI related, NFTs, and cryptocurrency.

Do not claim the artwork as your own creation.

Do not edit, modify any of my artwork without consent.

I have the right to decline your commission request.

Reposting commissioned pieces is allowed with proper credit.

Do not rush the Artist for completing the commission if the Client did not state the deadline in the beginning.

The Artist may not be available to answer queries on holidays, scheduled days off work, or emergencies. If you do not receive an email reply within 7 days, I encourage you to resend your email. Occasionally client emails are lost in the shuffle or accidentally deleted.

Commission slot is reserved and work time starts after payment is settled.

I have the right to decline any commission.

I work based on the queue line or closest deadline.

All commissions are delivered digitally.

There's no progress update for SKEB commission.

Commission work flow and update for client(s) (for non-SKEB).

^⤷ Rough sketch, if there's any major revisions or changes only can be done at this step.

^⤷ Lining and base coloring, minor revision still acceptable.

⤷ Rendering, not accepting any revision.

Major revisions example, such as:

^⤷ Changing the whole concept, composition, redesigning, etc.

^⤷ Adding additional characters and/or properties.

^⤷ Changing animation planning for anything animated.

Minor revisions example, such as:

^⤷ Changing the hair, skin, eyes base color. Text revisions for twitch panels.

Higher complexity will take more time to be finished.

The Artist may recycle sketches and preparatory works that were rejected by the Commissioner for other commissions or personal works.

The Artist will keep the artwork for 30 days after completion via digital means, barring any issues with hard drives/wipes. After that, the original piece may be gone and unable to be revised/worked on afterwards.

Payment will be done after we discuss the details of the commission, through Ko-Fi.

All prices are listed in USD.

I accept payment via Ko-Fi. Otherwise, I will use PayPal invoices.

PRIVATE COMMISSIONS (NDA)

Additional fee for 50% of the total commission cost

Private commissions process cannot be shown on my stream and social medias, and/or the final product cannot be showcased on my social medias and public portfolios within 30 days after completion, and/or the final product cannot be showcased on my social medias and public portfolios at any time.

MONETIZED CONTENT

Additional fee for 50% of the total commission cost, This commission fee is required if you intend to use the artwork for profitable digital activities, such as (but not limited to):

^⤷ Monetized video creation, such as music video, marketing purpose, etc.

Monetized content fee is not required for stream or video thumbnails.

COMMERCIAL MERCHANDISING

Additional fee for 150% of the total commission cost,

This commission fee is required if you intend to use the artwork for mass distribution and/or profitable activities, such as (but not limited to):

^⤷ Printing the artwork for sale

^⤷ Using the artwork for merchandise design/ sale

RUSHED COMMISSION FEE

Additional fee for 50% of the total commission cost

Rushed commission fee will be required if the deadline are under 1 week.

OTHER CHARGES

Complex design may increase the commission cost

Additional charges will be applied for designing work*

༝ Designing work*, such as: new character, mascot, outfit without references.

Refund and cancellation only can be done in these circumstances, such as:

I, the Artist, is the one who cancelled it and/or unable to finish the commission

Work for the commission have not started within 6 months after payment

Other than the circumstances that stated above, refund and cancellation cannot be requested by the Client

The client(s) must never request or submit a payment charge back under any circumstances. This will be considered as a violation towards my Terms of Service

In the event that a client is unreachable by ordinary contact means (email) for 3 months or more, the Artist reserves the right to cancel the commission and retain a 5% fee. If the Client is unreachable for 6 months or more, a refund will not be issued. The Client is welcome to receive credit valid toward another commission at the Artists current rate (having rescinded their spot in line due to lack of communication). If the client is unreachable for 1 year or more, then the payment is void.

I, the Artist, own the intellectual property rights & copyrights to the art work(s) and any original design. The intellectual property rights of the existing characters drawn belongs to their respective owners

Commissioned artwork (s) are personal use only. Otherwise, client(s) paid for the commercial rights that stated above

I, the Artist, have the rights to stream my work progress and showcased the final work on Twitch and/or social medias unless an NDA has been requested before starting the commission.

The Client is prohibited to resell the personal use commission/artwork.
